Terms of Service

These terms are the agreement between you and WorkAm when you use our website and services to find work, hire freelancers, and get paid.
1. About WorkAm
WorkAm is an online marketplace based in Nigeria that connects employers who need work done with freelancers and job seekers who do it. We provide job listings, applications, contracts, workrooms, milestone payments held in escrow, a wallet, and dispute resolution.
WorkAm is not an employer, recruitment agency, or party to the contracts between employers and freelancers. The employer and the freelancer are responsible for the work they agree on, and freelancers are independent contractors, not WorkAm employees.
2. Accepting these terms
By creating an account or using WorkAm you agree to these Terms, our Privacy Policy, Payments & Refunds Policy, Community Guidelines, and Cookie Policy. If you do not agree, do not use WorkAm.
3. Your account
- You must be at least 18 years old and able to enter a binding contract.
- Give accurate information about yourself and keep it up to date. One person or business may hold one account per role.
- Verify your email address. Some features, including withdrawals, only work after verification.
- Keep your password private. You are responsible for everything done through your account. Tell us straight away if you think someone else has access.
- Do not sell, transfer, or lend your account to anyone else.
4. For employers
- Job posts must describe real work, a real budget, and honest requirements.
- When you accept an application, you pay the agreed amount into escrow before work starts.
- Review each submitted milestone within 7 days. If you do not approve it or request a revision in that time, it is approved automatically and the payment is released.
- Do not ask freelancers to do unpaid test work beyond a reasonable, clearly described sample.
5. For freelancers and job seekers
- Your profile, skills, portfolio, and applications must be your own and truthful.
- Applying to jobs uses gig points. You receive free points each month and may buy more.
- Deliver the work you agreed to, on time, through the workroom so there is a record if a dispute arises.
- You are responsible for your own taxes and any registrations your work requires.
6. Fees and payments
WorkAm charges a platform fee of 10% of each contract amount, deducted before the freelancer is paid. Card and bank payments also include a 1.5% processing fee, paid by the customer on top of the amount. Payments are processed by Bachs. Keep payments on WorkAm. Do not ask for or accept payment outside the platform for work that started on WorkAm. Off-platform payments are not protected by escrow or disputes, and doing this may lead to suspension.
7. Your content and files
You keep ownership of what you post and upload, including profiles, messages, and work files. You give WorkAm permission to store, display, and process that content only as needed to run the service, for example to show your profile or deliver files to the other party.
Unless the employer and freelancer agree otherwise in writing, ownership of the finished work passes to the employer once the related milestone has been paid in full.
Work files are stored with a cloud provider and count against a storage allowance. Individual files are limited to 25 MB. We may remove files from closed contracts after a reasonable period, and you should keep your own copies of anything important.
8. Rules of conduct
You must follow our Community Guidelines. In short: no fraud, scams, harassment, discrimination, illegal work, fake reviews, spam, or attempts to break or misuse the platform.
9. Disputes between users
If an employer and freelancer cannot agree on a contract, either can open a dispute. Our team reviews the workroom messages, files, and milestone history and decides how escrowed funds are released or refunded. Both parties agree to give honest information and to accept our decision on the funds held in escrow. This does not stop you from pursuing other legal remedies against each other.
10. Suspension and closing accounts
We may warn, limit, suspend, or close an account that breaks these terms, puts other users at risk, or is involved in fraud. Where we can, we will tell you why. Funds that belong to you and are not connected to a dispute or suspected fraud will be paid out to you.
You can close your account at any time by emailing support@workam.com. Active contracts, open disputes, and wallet balances must be settled first.
11. Disclaimers and limits of liability
We work hard to keep WorkAm available and secure, but it is provided "as is". We do not guarantee that you will find work or hires, and we are not responsible for the quality, legality, or delivery of work agreed between users.
To the extent the law allows, WorkAm is not liable for indirect or consequential losses, lost profits, or lost data, and our total liability to you for any claim is limited to the fees you paid WorkAm in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
12. Changes to these terms
We may update these terms as WorkAm grows. We will change the "last updated" date and, for significant changes, notify you by email or in the app before they take effect. If you keep using WorkAm after that, you accept the updated terms.
13. Governing law
These terms are governed by the laws of the Federal Republic of Nigeria. Any dispute with WorkAm that we cannot resolve together will be handled by the courts of Nigeria.
